Will Your POS Solution Comply with France’s 2016 Finance Act? Openbravo will!

In January 2018, French law will require all retailers to use POS systems that comply with specific standards designed to reduce VAT fraud.

To meet the needs of our clients in France, Openbravo is currently working with the Laboratoire National de Métrologie et d’Essais (LNE) to ensure that its POS solution included in the Openbravo Commerce Suite is compliant with French law by January 2018.

Why does France have new requirements for POS systems?

Currently, many POS systems allow businesses to avoid registering a sale and the taxes that go with it, particularly when it comes to cash sales, or allow them to “remove” a sale from the server and effectively wipe it from any digital record.

To prevent this kind of fraud through cash registers and POS devices, Article 88 of the 2016 Finance Act requires all businesses update their POS software to ensure the integrity of sales.

Why upgrade your POS system with Openbravo?

Up to three-quarters of businesses will likely have to upgrade their POS system, and businesses found with non-compliant POS systems will be fined € 7,500, renewable every 30 days until the certification is confirmed. Unfortunately, many POS systems being used today will not be upgraded, either because they are too old or because the certification process may be too expensive.

What does certification mean?

There are two certification organizations in France that can issue the certificates needed to comply with the 2016 Finance Act: INFOCERT, which offers the NF525 certification, and the Laboratoire National de Métrologie et d’Essais (LNE), which offers a Cash Management System certification.

Both options are designed to satisfy all the requirements set by the 2016 Finance Act.

The certification process requires all POS systems fulfill four conditions: data inalterability, security, storage, and archiving standards. Essentially, this means POS software must be coded to guarantee that data from every sales process is collected, stored, and archived securely and that it remains traceable in its integrity.

Openbravo has chosen LNE’s Cash Management System certification and to ensure its POS system is compliant with French law by January 2018.
